“By signing this document, I recognise that I have read and accept without reservations the SPECIAL CONDITIONS below and that govern the use of the Clients’ area.”
“These conditions (the “SPECIAL CONDITIONS” from now on) regulate the terms and conditions for using the Clients’ Area (the “SERVICE” from now on) that ZAYER, SA (“ZAYER” from now on) makes available to its clients via the Web site www.zayer.com/es (the “WEB SITE” from now on).
The terms that appear in upper case in these SPECIAL CONDITIONS must be interpreted according to the definition set for them, generally, in the Legal Notice and conditions for use for the WEB SITE, the text of which governs, for whatever is not described in these SPECIAL CONDITIONS and additionally, the relationship between ZAYER and the USER regarding the use of the SERVICE.
The registration of the USER will require the use of the form made available to ZAYER clients, the USER and/or the company to which he or she provides his or her services being responsible for providing true and licit information for the purpose.
With this registration, ZAYER will allocate the USER (i) a log-in name and (ii) a password, which will allow access to the Clients’ Area of the WEB SITE at all times.
The USER is obliged to use the allocated login name and password diligently and will be responsible for their suitable safekeeping and confidentiality, undertaking not to cede their use to third parties, whether temporarily or permanently and not to allow access by unauthorised persons.
In the event of the theft or loss of or unauthorised access using a login name and password, the USER will be responsible for immediately reporting this circumstance to ZAYER so that it can cancel them. In no case will ZAYER be responsible for the actions of unauthorised third parties that use the USER’s login name and password before this notification is received from the USER.
The access to and use of the SERVICE is free except for the cost of the connection to the telecommunications system contracted by the USER with a provider.
All the industrial and intellectual rights to the contents to which the USER may have access when using the SERVICE are legally reserved and access to them or their use by the USER must not be considered as granting any licence for the use of or right to them without prejudice to what ZAYER may have agreed with its client specifically and in writing in each case.
The USER is obliged to make use of the SERVICE abstaining from (i) undertaking any conduct that may damage the image, interests and rights of ZAYER or of third parties or that may damage, disable or overload the SERVICE or that in any way impedes its normal use and (ii) use the SERVICE in a manner contrary to these SPECIAL CONDITIONS and to the laws and uses of the traffic.
As a consequence, the USER will be liable to ZAYER and/or to third parties for any damages and prejudices that may be caused as a consequence of failing to comply with these obligations and the inappropriate use of the SERVICE.
ZAYER adopts the security measures it considers pertinent to maintain the proper functioning of the SERVICE and to detect the existence of viruses and harmful components. Despite this, the USER must be aware that the security measures in computer systems on the Internet are not entirely reliable and therefore ZAYER cannot guarantee (i) the continuous availability of SERVICE, (ii) the absence of errors in the contents made available to his or her through the SERVICE, (iii) the non-existence of viruses or other harmful elements that could cause alterations in the USER’s computer systems (software and hardware) or in the electronic documents and files contained in them, nor (iv) the infallibility of the security measures adopted.
Likewise, ZAYER reserves the right to partially or totally interrupt the SERVICE, temporarily or permanently, for technical changes or faults, communicating it beforehand if possible through the WEB SITE or through any other means available for the purpose without accepting any liability to the USER and/or company for which it provides its services due to this circumstance.
In virtue of the following, the privacy policy is established which, generally, governs the collection and processing by ZAYER of personal data provided for registering USERS to use the SERVICE.
In accordance with Organic Law 15/1999, 13 December, on the protection of personal data, the USER is informed of the existence of a personal data file for which ZAYER is responsible, duly registered in the Spanish Data Protection Agency and created for managing the relationship with the USER and to permit his or her access to the SERVICE.
The acceptance of these SPECIAL CONDITIONS implies the consent of the USER to the processing of the data provided via the registration form.
The provision of information required in the registration form is obligatory. The failure to fill in this information or the provision of incorrect data will make it impossible for ZAYER to manage the USER’s registration request and for the USER to access the SERVICE.
Any modification that may be made to the personal data must be communicated to the person responsible for the file by the USER and/or by the company in which the USER provides his or her services, being responsible in any case for the truth and exactness of the data supplied at all times.
If it is the company in which the USER provides his or her services that supplies the data, this company must declare that it has the USER’s consent for this communication of data.
USERS may exercise their rights of access, correction, cancellation and objection to the processing of their personal data in the terms and conditions described in Organic Law 15/1999, 13 December, on the protection of personal data, with a request sent in writing to the attention of the person responsible for the file in the terms of current legislation to the following address: ZAYER, SA, Polígono Industrial Betoño, Portal de Bergara 7, 01013 Vitoria-Gasteiz (Álava).
ZAYER guarantees the confidentiality of the personal data provided by the USER and its processing in accordance with current personal data legislation, undertaking to keep them secret.
Likewise, the USER is informed that ZAYER maintains the security levels to protect data in accordance with Royal Decree 1720/2007, 21 December, approving the regulations arising from Organic Law 15/1999, 13 December, on the protection of personal data, and has set up all the technical means available to it to prevent the loss, misuse, alteration, unauthorised access and/or theft of the data that the USER provides to ZAYER, without prejudice to informing USERS that the security measures on the Internet are not impregnable.
